      they are respectively the executrix and executor named in the last will 
      and testament of James Hoy [sic] dated the first day of December AD 
      1880.
 That said James Hoy [sic] departed this 
      life at Kearney in the County of Hudson and State of New Jersey on 
      Wednesday the 31st day of May AD 1882 leaving his surviving as his heirs 
      at law and next of kin the following named persons to wit:
 Ann Hoy his 
      widow and
 Charles Hoy a son, both residing at No. 408-3rd St Kearney 
      Township, Hudson County, New Jersey.
 That said 
      testator died seized of real estate to the value of 2000-00/100 and was 
      possessed of personal property to the value of 125-00/100. Therefor the

      sound and disposing mind, memory and understanding (for which blessing I 
      thank God) do make, publish and declare this my last will and testament in 
      manner following.
 First, I direct all my just 
      debts and funeral expenses to be paid as soon as may be reasonable after 
      my decease.
 Second, it is my will and I do 
      order and direct that all my furniture in and about my house be given at 
      my death to my wife Ann Hoy for her use 
      forever.
 Third, it is my will and I do order 
      and direct that all my real estate shall go to and be use by my said wife 
      for and during her natural life unless sooner sold or disposed of, in 
      which case the proceeds of said sale to be invested by my executor 
      hereinafter named in some safe and secure manner and the interest thereof 
      paid to my said wife half yearly & oftener if required by her if 
      thesame  can be, and at her death the said real estate if

      property of my son Charles Hoy and in case my said real estate shall have 
      been sold & disposed of at my wife's death, then the funds remaining

      divided between my relatives and the relations of my said wife in equal 
      parts the last clause above mentioned only to have effect in case my said 
      son shall die without heirs and in case he shall at his death and the 
      death of my said wife leave an heir or heirs then the said heir or heirs 
      to inherit instead of the relative of my said wife & myself 
      mentioned.
 Fourth, I do hereby authorize my 
      executors hereinafter named in case it shall be necessary so to do 
      in consequence of the income of my said estate not being sufficient 
      for the support of my said wife to mortgage my said real estate to an 
      amount no to exceed five hundred dollars and the proceeds thereof given to 
      my said wife.
 Fifth, I do order and direct 
      that all the rest and residue of my estate shall go to and be the property 
      of my said son & his heirs forever.
 Sixth, 
      I do hereby charge my my [sic] estate of every kind with the 
      payment of the sum of two hundred dollars as`soon after my death & the 
      death of my wife Ann Hoy ^as may be^ to pay for saying mass or 
      masses over the remains of my first wife Ellen Hoy or my second wife Ann 
      Hoy & myself the same to be paid to St. Pius Roman Catholic Church of 
      East Newark in the County of Hudson.
 Seventh, 
      I do hereby authorize and empower my executor hereinafter named to sell 
      and dispose of all my real estate and personal...not otherwise disposed of 
      in case it shall be to the interest of my estate so to do & give good 
      and sufficient deed or deeds therefor and when sold the proceeds of such 
      sale to be invested in some safe and secure manner by my executors & 
      the interest therof paid half yearly to my wife as 
      aforsaid.
 Lastly, I do hereby constitute and 
      appoint my dear wife Ann Hoy and my fiend Joseph McAvoy executors of this 
      my last will and testament.
